Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the iPlane mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and AT Software ("we," "us," or "our") governing your use of the App.

2. Description of Service

iPlane is a mobile application that provides:

  • Real-time flight status information and tracking
  • AI-powered aviation assistance and queries
  • Airport passenger load forecasts
  • Push notifications for flight updates
  • Aircraft information and photos

The App is designed for informational purposes only and should not be relied upon as the sole source for critical travel decisions.

3. Changes to the Service

We may add, remove, or modify features (including Premium features) at any time, including to improve performance, address security issues, comply with law, or adapt to data-source availability.

Some features may be available only in certain regions, airports, or platforms, and may change over time.

4. User Eligibility

You must be at least 13 years old to use this App. By using the App, you represent and warrant that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into these Terms
  • You are not prohibited from using the App under applicable laws

5. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on your personal mobile device
  • Use the App for your personal, non-commercial purposes

This license does not include the right to:

  • Modify, copy, or create derivative works of the App
  • Reverse engineer, decompile, or disassemble the App
  • Remove any proprietary notices or labels
  • Use the App for any commercial purpose without our written consent

6. User Conduct

When using the App, you agree NOT to:

  • Use the App for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to our systems or data
  • Interfere with or disrupt the App's functionality or servers
  • Use automated systems or bots to access the App
  • Scrape, harvest, or collect data from the App without permission
  • Transmit viruses, malware, or other harmful code
  • Impersonate any person or entity
  • Use the App to harass, abuse, or harm others

7. Flight Information Disclaimer

⚠️ Important Notice

Flight information provided by the App is for informational purposes only.

You acknowledge and agree that:

  • Flight data is sourced from third-party providers and airport systems
  • Information may be delayed, incomplete, or inaccurate
  • We are not responsible for flight schedule changes, cancellations, or delays
  • You should always verify flight information with your airline or airport
  • The App should not be used as your sole source for time-critical travel decisions

We strongly recommend arriving at the airport with adequate time and confirming all flight details with official sources.

8. AI Assistant Disclaimer

The AI Assistant feature uses artificial intelligence to answer questions about flights and aviation:

  • AI responses are generated based on available data and may not always be accurate
  • The AI may occasionally provide incorrect or outdated information
  • AI-generated content should be verified against official sources
  • We are not liable for decisions made based on AI responses

9. Subscriptions, Premium Features, and Billing

The App may offer paid subscription plans (for example, “Pro” and “Business”) that unlock additional features (“Premium Services”). Available plans, pricing, and included features are shown in the App and/or the applicable store listing at the time of purchase.

9.1 Platform Processing (Apple / Google)

Unless otherwise stated at the time of purchase, subscriptions are processed by your platform provider (Apple App Store or Google Play). The platform provider is the merchant of record and handles billing, payment processing, taxes, and refunds in accordance with its policies.

9.2 Auto-Renewal

Subscriptions typically renew automatically unless canceled before the end of the current billing period. Your account will be charged for renewal within the window defined by the platform provider’s rules. You can manage or cancel your subscription through your device’s subscription settings.

9.3 Free Trials and Promotions

If a free trial or promotional period is offered, it will be disclosed at the time of purchase. Unless you cancel before the end of the trial or promotional period, your subscription will convert to a paid subscription and renew automatically in accordance with these Terms and your platform provider’s policies.

9.4 Price Changes

Pricing may change over time. If the platform provider requires your consent to a price change, you will be notified by the platform provider. If consent is required and not provided, your subscription may be canceled at the end of the current period.

9.5 Cancellation

You must cancel through the platform that processed your purchase. Deleting the App does not cancel your subscription. Unless otherwise required by law, cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable.

9.6 Refunds

Refund requests are handled by the platform provider under its refund policies. We cannot issue refunds for purchases processed by Apple or Google.

9.7 Entitlements and Verification

To provide Premium Services and prevent fraud, we may validate purchase receipts or signed transaction tokens with the platform provider and maintain a record of your entitlement status. If validation fails, Premium features may be restricted until the issue is resolved.

9.8 Feature Availability

Premium Services may depend on third-party data sources, platform capabilities, and network connectivity. We do not guarantee that a specific Premium feature will be available at all times in all regions or airports.

10. Intellectual Property

The App and all content, features, and functionality are owned by AT Software and are protected by international copyright, trademark, and other intellectual property laws.

This includes but is not limited to:

  • The iPlane name, logo, and branding
  • App design, graphics, and user interface
  • Software code and algorithms
  • Documentation and written content

Aircraft photos displayed in the App may be subject to third-party copyrights and are used under license from Planespotters.net and individual photographers.

11. Third-Party Content and Services

The App may contain links to or integrate with third-party services:

  • We are not responsible for third-party content, products, or services
  • Your use of third-party services is governed by their respective terms
  • We do not endorse or guarantee third-party offerings

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY, RELIABILITY, OR COMPLETENESS OF INFORMATION

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AT SOFTWARE BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or use
  • Missed flights, travel delays, or related expenses
  • Damages resulting from reliance on App information

Our total liability shall not exceed the amount you paid for Premium Services in the past 12 months, or $100, whichever is greater.

14. Indemnification

You agree to indemnify, defend, and hold harmless AT Software and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of a third party

15. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for any reason, including:

  • Violation of these Terms
  • Illegal or harmful conduct
  • At our sole discretion

You may terminate your use of the App at any time by uninstalling it from your device.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted to this page. Continued use of the App after changes constitutes acceptance of the modified Terms.

For significant changes, we will provide notice through the App or other appropriate means.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law provisions, except where consumer protection laws of your jurisdiction require otherwise.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in Hong Kong, to the extent permitted by law. Where arbitration is not permitted, disputes will be resolved in the courts of competent jurisdiction.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AT Software regarding your use of the App.
